Purchasing a villa in Thailand is entirely possible for foreigners — with the right legal structure in place. While Thai law restricts direct land ownership by foreigners, there are fully legal and secure options that allow you to own the villa structure and gain long-term control of the land:
- Leasehold Option: This is the most common and straightforward method. Foreign buyers can lease the land for an initial term of up to 30 years, with two optional 30-year renewals, totaling 90 years. This structure is legally recognized and widely used in luxury villa developments like La Felice.
- Thai Limited Company: Some foreign investors choose to establish a Thai-registered company to legally hold the land. When done correctly with legal guidance, this structure offers a more direct and long-term form of control. It is important that the company is set up in compliance with Thai regulations.
Note: Foreigners can fully own the villa (building) in their own name, even if the land is held via leasehold or through a Thai company.
